1. Our Agreement With You

1.1 Parties Involved: This Terms and Conditions document ("Agreement") establishes a legally binding contract between you (the "customer," "user," "Sender") and Tufhapay ("we," "us," "our"). Tufhapay provides the platform and user interface through which you access the global payment services of our licensed partner, Belmoney S.A. ("Belmoney"). By using our services, you enter into this agreement with Tufhapay and also agree to the underlying terms of service provided by Belmoney, who is the regulated entity processing your transactions.

1.2 Acceptance of Terms: By creating a Tufhapay profile, initiating a transaction, or otherwise using our website or mobile applications (collectively, the "Platform"), you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of these terms, you must not use our services.

1.3 Additional Documents: Our Privacy Policy and Cookie Policy are integral parts of this Agreement. These documents contain critical information about how your personal data is collected, used, and protected. The current versions of all legal documents are available on our website for you to review, download, and store.

2. Our Services

2.1 Money Transfers: Our service enables you to send money internationally to a designated recipient ("Beneficiary"). Tufhapay provides the technology platform to initiate these payment orders ("Transactions"), which are then processed, fulfilled, and settled by our regulated partner, Belmoney.

2.2 Recommended Use: We strongly advise that you only use our services to send money to people you know and trust, such as friends and family. Sending money to strangers is strongly discouraged, as Tufhapay and Belmoney cannot be responsible for the quality or delivery of goods or services purchased from third parties.

2.3 Third-Party Agreements: Your use of our services may require you to comply with separate agreements with third parties, such as your mobile device manufacturer, network operator, or banking institution. You are solely responsible for adhering to those agreements.

3. Getting Started & Using Our Services

3.1 Profile Creation: To use our services, you must create a Tufhapay profile. This profile is a record of your information required for identity verification and transaction processing. It is not a bank account or payment account and does not store monetary value.

3.2 Individual Use & Profile Limit: You may only create one (1) profile and must use it for your own individual purposes. Creating a profile or initiating transactions on behalf of another person is strictly prohibited.

3.3 Eligibility: To use our services as a Sender, you must:

  • Be at least eighteen (18) years old.
  • Be a resident of a country in the European Union, Liechtenstein, Norway, or Iceland.
  • Agree to this Agreement and all related policies.
  • Successfully complete our identity verification and information collection processes as required by law.

4. Sending Money & Service Fees

4.1 Funding Instruments: You may pay for your transaction using a permitted funding instrument, which includes a valid debit/credit card or a bank transfer (such as the EU/EFTA "SEPA" scheme). You represent and warrant that you are the lawful owner of any payment instrument used on our Platform.

4.2 Service Fees & Exchange Rates: For each transaction, you agree to pay a Service Fee in addition to the transaction amount. The applicable Service Fee and the foreign currency exchange rate will be clearly and transparently displayed to you before you provide your consent to proceed with the transaction. By confirming the transaction, you agree to the quoted rate and fees.

4.3 Third-Party Fees: Tufhapay and Belmoney are not responsible for any additional fees charged to you by third parties. This includes, but is not limited to, "cash advance" fees from credit card issuers or fees charged by your personal bank.

4.4 Transaction Execution: Transaction delivery times vary based on the destination country and payout method. Estimated delivery times (e.g., "Immediately" for Brazil PIX, "24h" for home delivery) will be communicated to you during the transaction process.

5. Important Service Restrictions

5.1 Right to Limit or Refuse Transactions: To protect our users, comply with legal and regulatory obligations, and manage risk, our partner Belmoney reserves the absolute right to refuse, delay, suspend, or limit any transaction at its sole discretion. This includes applying enhanced due diligence measures to transactions involving jurisdictions designated as high-risk.

5.2 Restricted Activities: You are strictly prohibited from using our services for any illegal purpose or in violation of this Agreement. Restricted Activities include, but are not limited to, transactions related to:

  • Gambling, fraud, or money laundering.
  • Sexually-oriented materials or services.
  • The purchase or sale of tobacco, firearms, prescription drugs, or other controlled substances.
  • Financing of terrorism.

Engaging in Restricted Activities may result in the immediate suspension or termination of your profile, cancellation of transactions, and reporting to the relevant law enforcement or regulatory authorities.

6. Cancellations, Refunds, and Error Resolution

6.1 Cancellations & Refunds: You may cancel a transaction for a full refund at any time before it has been completed (i.e., before the funds have been paid out to or deposited for the Beneficiary). Once a transaction is marked as complete, no refunds are possible. Refunds will be credited back to the original funding instrument.

6.2 Error Resolution: If you believe an unauthorized or incorrectly executed transaction has occurred, you must notify us without undue delay. To ensure we can investigate properly, you must report any issues within 13 months of the transaction date. Failure to do so may limit our ability to assist you or issue a refund.

7. Liability and Disclaimers

7.1 Our Responsibility: We are responsible for loss or damage you suffer that is a foreseeable result of us breaking this Agreement or failing to use reasonable care and skill. We are not liable for business-related losses, unforeseeable losses, or damages resulting from events outside our reasonable control (Force Majeure).

7.2 Your Responsibility: You agree to compensate and hold harmless Tufhapay and Belmoney (including their directors, employees, and partners) from any losses, claims, or expenses arising from your violation of this Agreement, your improper use of the services, or your violation of any law or third-party rights.

8. Dispute Resolution and Governing Law

8.1 Dispute Resolution: If you have a complaint, please contact Tufhapay customer support first to allow us to resolve the issue. If we cannot reach a resolution, you may have the right to use an Alternative Dispute Resolution (ADR) service, such as the European Online Dispute Resolution (ODR) platform.

8.2 Governing Law: This Agreement and all matters arising from it shall be governed by and construed in accordance with the laws of Belgium. Any legal proceedings related to our services shall be brought exclusively in the competent courts of Belgium. This does not affect your statutory rights as a consumer in your country of residence.

9. Other Important Terms

9.1 Changes to this Agreement: We reserve the right to modify this Agreement at any time. We will provide notice of material changes by posting the revised Agreement on our Platform. Your continued use of the services after such changes constitutes your acceptance of the new terms.

9.2 Transfer of Agreement: We may transfer our rights and obligations under this Agreement to another organization. You may only transfer your rights or obligations if we agree in writing.

9.3 Severability: If any court or relevant authority decides that any part of this Agreement is unlawful, the remaining paragraphs will remain in full force and effect.
